Terms of Use

These Terms of Use govern your use of:

• Products and services provided by Hadō (the "Services")
• Data, information, reports, written content, and structured/unstructured data available through the Services (the "Data")
• Hadō's website (www.hado.codes), related platforms, and apps, including Opswiz (collectively, "Hadō's Platforms")

You may use the Services and Data only for purposes expressly permitted in these Terms. You agree to:

• Use the Services and Data in accordance with all applicable laws and regulations
• Use the Services and Data only for legal, ethical, and legitimate purposes
• Ensure use does not harm Hadō's reputation, directly or indirectly

Data Protection and Integrity

• Download, reverse engineer, modify, aggregate, or decompile the Data or software contained in Hadō's Platforms
• Copy, sublicense, resell, reproduce, duplicate, or publish the Services or Data
• Transfer, forward, or make available the Services or Data to any person not authorized to access them
• "Mirror" Data on any other server
• Remove or obscure copyright or proprietary notices from the Data or content on Hadō's Platforms
• Engage in web scraping or unauthorized automated data collection

Intellectual Property and Attribution

• Attribute the Services or Data to any person or organization other than Hadō
• Use the Data as part of developing or operating financial, investment, or other products, indices, or instruments, without express written consent from Hadō
• Use the Data in advertising or marketing without Hadō's prior written consent

• Import or transfer information or content to Hadō's Platforms that is:
  • Inaccurate, misleading, defamatory, obscene, abusive, or offensive
  • In breach of any intellectual property right, privacy right, or other third-party rights
  • Damaging to the performance of the Services
• Modify or adapt the Services or Data, including any application programming interfaces (APIs) or web application interfaces used to access them

By using Hadō's Services, you grant Hadō a non-exclusive, worldwide, perpetual, transferable, irrevocable, and royalty-free license to:

• Use, store, process, reproduce, modify, anonymize, and aggregate maritime-related datasets you upload to Hadō's Platforms
• Create derived works and improve our Services and Data
• Refine our internal models and methodologies

Provided "As Is"

The Services and Data are provided on an "as is" and "as available" basis. Although Hadō endeavours to keep information accurate and up to date, it does not guarantee the completeness or accuracy of the data provided through the Service in any form (including images, video, text, graphics, etc.).

No Warranty

The Data have been published without any warranty, whether express or implied. Hadō makes no representation, warranty, assurance, or undertaking regarding:

• The adequacy, accuracy, completeness, or reasonableness of the Data
• That the Service will be error-free, virus-free, or continuously available
• That you will have uninterrupted access to Hadō's Platforms

All responsibility and liability are expressly disclaimed to the maximum extent permitted by applicable law.

Internal Use Only

The display, creation of derived data, and internal distribution of Data through the Service within your organization are permitted solely for internal business purposes. Any other external dissemination is strictly prohibited unless expressly indicated in these Terms or another contractual agreement with Hadō.

Commercial use of Hadō's data gathered through this Service is prohibited without obtaining a license from Hadō.

Your Sole Responsibility

You are solely responsible for all decisions, acts, and omissions based on the Service or Data. Hadō assumes no liability for actions undertaken by you based on information provided on Hadō's Platforms. You access Hadō's Platforms at your own initiative and risk.

AIS Data Limitations

Vessel position and identity information originates directly from vessels transmitting through publicly accessible radio frequencies using the Automatic Identification System (AIS). This information may contain errors due to:

• Intrinsic limitations of radio communications (limited coverage, interference, attenuation, weather conditions)
• Erroneous configuration of AIS devices on board
• Negligent data entry by vessel crew
• Erroneous GPS positions received by vessels
• Other factors beyond Hadō's control

Vessel positions may be up to one day old or incomplete. Data is provided for informational purposes only and is not related to the safety of navigation. Hadō, its administrators, and partners provide no guarantee of correctness, validity, completeness, or accuracy and are not responsible for suitability of usage for purposes other than informational.

Data Completeness

Hadō does not warrant that the Data provided under this Service contain all nautical navigation or other relevant data existing worldwide.

Right to Modify

Hadō reserves the right to change the Data from time to time in accordance with its methodologies, policies, and procedures.

By using Hadō's Services, you grant Hadō a non-exclusive, worldwide, perpetual, transferable, irrevocable, and royalty-free license to:

• Use, store, process, reproduce, modify, anonymize, and aggregate maritime-related datasets you upload to Hadō's Platforms
• Create derived works and improve our Services and Data
• Refine our internal models and methodologies

Provided that Hadō shall not use such Data to identify you. Hadō may combine or incorporate your data with similar data from other users, customers, or sources.

Excluded Liability

To the maximum extent permitted by applicable law, Hadō excludes all liability for:

• Direct, indirect, or consequential damages or losses arising from use of or reliance on the Data
• Indirect, incidental, special, punitive, consequential, or exemplary loss or damage
• Loss of profits, sales, business, contracts, opportunities, revenue, anticipated savings, technology, data, or goodwill
• Business interruption or wasted management time
• Any claims arising from contract, tort, negligence, strict liability, or other legal theory

This limitation encompasses all such claims whether foreseeable or not.

Virus and Security

Hadō disclaims liability for losses or damages from viruses, distributed denial-of-service attacks, or other technologically harmful materials that compromise your computer equipment, programs, data, or proprietary material through use of Hadō's Platforms or linked websites.

Disclaimer of Warranties

Subject to any pre-existing contractual relationship between you and Hadō, Hadō disclaims all conditions, warranties, representations, or other terms that may be implied (whether express or implied) in relation to Hadō's Platforms or any data provided through these means.

You may not use, promote, or sell any products or services containing the Data to:

• Any individual or entity owned, controlled, or associated with a proscribed or sanctioned country
